• You have the legal rights to upload and promote your content.
• Your use of the Service complies with all applicable laws and regulations.

3. Description of Service

PopMyFlix provides an online platform that helps creators, businesses, and advertisers promote video content, manage advertising campaigns, monitor campaign performance, and access analytics.

Our services may evolve over time, and we reserve the right to add, modify, suspend, or discontinue features without prior notice.

4. User Responsibilities

You agree to:

• Keep your login credentials secure.
• Use the Platform only for lawful purposes.
• Ensure all uploaded content belongs to you or that you have permission to use it.
• Comply with YouTube policies, Google Ads policies, and any applicable third-party platform guidelines.

You must not:

• Upload misleading, fraudulent, or illegal content.
• Promote copyrighted material without authorization.
• Attempt to hack, disrupt, or interfere with our systems.
• Use bots, scripts, or automated tools to abuse the Platform.
• Engage in activities that violate intellectual property rights or applicable laws.

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials. Any activity performed through your account is considered your responsibility. If you believe your account has been compromised, please notify us immediately.

6. Payments & Subscription

Certain features of PopMyFlix require payment. By purchasing any plan, you agree that:

• Prices are displayed before purchase.
• Payments must be completed through our approved payment partners.
• Subscription plans renew only if specified during purchase.
• Taxes, if applicable, are charged according to local laws.
• Failure to complete payment may result in suspension or cancellation of the purchased services.

7. Campaign Performance Disclaimer

While PopMyFlix strives to optimize advertising campaigns using intelligent automation and best practices, we do not guarantee:

Campaign performance depends on various external factors including audience behavior, advertising competition, platform algorithms, video quality, targeting, and budget.

8. Third-Party Services & YouTube Integration

Our Platform integrates with third-party services to deliver seamless advertising and analytics workflows, including:

• YouTube & YouTube API Services: By linking your YouTube channel or using our video analytics/promotion tools, you explicitly agree to be bound by the YouTube Terms of Service and the Google Privacy Policy.
• Google Ads & Google Analytics
• Payment Gateways & Financial Partners

These third-party services are governed by their own respective terms and privacy policies. PopMyFlix is not responsible for their availability, functionality, algorithms, or policy revisions.

9. Intellectual Property

All software, branding, logos, designs, graphics, source code, documentation, and content belonging to PopMyFlix remain the exclusive property of Everonic Solutions Pvt. Ltd.

You may not copy, reproduce, modify, distribute, reverse engineer, or commercially exploit any part of the Platform without prior written permission.

10. User Content

You retain ownership of the content you upload. By submitting content to PopMyFlix, you grant us a limited, non-exclusive license to process, display, and use that content solely for providing the requested services.

You remain solely responsible for the legality and ownership of your uploaded content.

11. Service Availability

We strive to maintain uninterrupted service; however, we cannot guarantee continuous availability. Temporary interruptions may occur due to scheduled maintenance, software updates, technical issues, network failures, third-party outages, or force majeure events.

12. Limitation of Liability

To the maximum extent permitted by law, Everonic Solutions Pvt. Ltd., its directors, employees, affiliates, and partners shall not be liable for any indirect or consequential damages, loss of profits, business interruption, loss of data, advertising performance losses, revenue loss, or reputation damage arising from the use or inability to use the Service.

Our total liability shall not exceed the amount paid by you for the specific Service giving rise to the claim.

13. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding continuous availability, error-free operation, compatibility with every device or browser, specific advertising results, or the accuracy of third-party data. Use of the Platform is entirely at your own risk.

14. Suspension & Termination

We reserve the right to suspend or terminate your account without prior notice if you violate these Terms, misuse the Platform, engage in fraudulent activities, fail to comply with applicable laws, or abuse payment systems or other users. Termination does not relieve you of outstanding payment obligations.

15. Privacy

Your use of PopMyFlix is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information and third-party account data.

16. Changes to These Terms

We may revise these Terms from time to time. Updated versions will be published on this page with a revised "Last Updated" date. Continued use of the Service after such updates constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Lucknow, Uttar Pradesh, India.
